Contract forms and procurement terms and conditions

We tender a contract as a public contract or as a framework agreement. In doing so, we use parity Requirements or the Water Board Procurement Requirements.

  • A government contract is a written agreement between HHNK, one or more companies and possibly one or more other authorities. In a government contract we make performance agreements with the party or parties involved about the execution of works, the supply of products or services. In doing so, we follow the European procurement directive and a purchase and delivery obligation applies. The duration is freely determinable.
  • A framework agreement or master agreement is not a contract but a preliminary step for awarding future contracts (products, services or works). For the term of this agreement, we lay down delivery terms on the basis of which we award future contracts. Consider, for example, price, quality, quantity and delivery time. We conclude a framework agreement with one or more entrepreneurs (at least three). If several parties are involved, we apply competition when awarding contracts under the framework agreement. We lay down the Requirements for this mini-competition in the framework agreement. The term of a framework agreement is four years, but sometimes we deviate from this. In such a case, we motivate that choice.

Agreements for works

For the execution of works, we use integrated contract forms based on the jointly established Requirements UAV-GC 2005. Engineering & Construct and Design & Construct are the most common forms.

  • We use Engineering & Construct contracts for projects with no or a small design component: the contractor performs the work with a minimal share of detail engineering. This form of contract is very similar to Design & Construct, but the design is limited to engineering. We prepare a functionally specified request for proposal.
  • We use Design & Construct contracts when the contractor is responsible for designing and constructing a work. We draw up a functionally specified request for proposal. The contractor is given room to apply innovations. Design and execution must be as closely aligned as possible.
  • We also tender works based on the RAW system: the standard specifications system in the GWW sector. This means that we lay down exactly what the desired solution is in specifications and drawings. The contractor then carries out this design. The contracts we conclude for this purpose are based on the Uniform Administrative Requirements 2012(UAV-2012), which may include project-specific exceptions to these Requirements in the specifications or the work description.
