New procedure for lease and rental plots
Our Board has adopted the Real Estate Policy and the Real Estate Policy Implementation Rules. Part of this is the changed procedure for the issuance of vacant lease and rental lots and entirely new lots to be put into use. As a result of the Didam Judgment, this will be subject to a public procedure. This public procedure does not apply to existing agreements that can be renewed.
Leasehold
Category 2
When a lease expires and the lease plot can be put back into use, the lease plot is in principle offered again to the same tenant. We strive for cooperation with the tenants and good management of our properties. Continuous use and the steady relationship with the tenant contributes to a committed tenant, who invests in the lease plot, complies with the Requirements and improves soil life. This intention is not published separately. The publication of these general selection and award criteria complies with the Didam ruling. Publishing them separately has no further added value.
Category 2a
When a plot becomes available, we publish the plot on www.overheid.nl. The lease prices are fixed and therefore do not affect the selection. If there are several comparable applicants who are willing and able to meet our policies and Requirements, we draw lots. The draw is done by Land Affairs in the presence of three people. Unsuccessful bidders will be notified of award to a third party. Further substantive information will not be provided.
Criteria
In addition to the requirements in the lease, the lease agreement and the other Requirements in the Real Estate Policy and these Implementation Rules, the following criteria are applicable for selection & award:
- The tenant is running an agricultural business. The tenant must prove this with the registration in the Chamber of Commerce with the SBI code Agriculture. In case of doubt, the registration will fall outside the selection.
- The lease plot is within 10 kilometers of the tenant's farm.
- The lease plot must be operated by the tenant himself.
- The lessee is able and willing to comply with HHNK's policies and stated lease conditions.
In addition to the above criteria, for parcels of loose land depending on location, intended use and situation of the parcel, additional criteria are established for the purpose of promoting sustainability, biodiversity and improving soil life.
Vacant plots up to an area of 1 hectare can also be given to a hobby farmer in use (no lease). They can then also apply for publication. Commercial farmers have priority in the selection and the hobby farmer must live within a radius of 5 kilometers from the published plot.
In addition to the above, we reserve the right to set additional criteria on a case-by-case basis if circumstances warrant. We also reserve the right to ultimately not award the plot and (still) maintain it ourselves.
Rent
Category 3
Properties that are leased and whose lease is ending and can be renewed are offered to the outgoing tenant. The leasing of these properties need not be published separately.
Category 3a
In principle, a new plot to be leased can be offered to the applicant if circumstances permit. For the category and criteria, the procedure for Selling, Category 1a is followed. If the plot to be let is not yet in use but is adjacent to the applicant's property and in the judgment of Grondzaken there is one candidate, then award to the applicant is permitted. The applicant must (be able to) comply with our policy. The intention to award will be published on our website.
Category 3b
Free lots for which, in the judgment of GZ, several candidates can be identified will, depending on the potential yield, be publicly offered through www.overheid.nl. We may impose special requirements at the time of publication that limit the size of the potential candidates, such as the presence/presence of an access to the public road. In principle, the property is leased to the highest bidder who is able and willing to comply with our policy.
