New procedure for leased and rented plots
Our board has adopted the Real Estate Policy and the Real Estate Policy Implementation Rules. Part of this is the amended procedure for the issuance of vacant leasehold and rental plots and plots that are to be put into use for the first time. As a result of the Didam ruling, a public procedure will be followed for this. This public procedure does not apply to existing agreements that can be renewed.
Lease
Category 2
When a lease agreement expires and the leased land can be put back into use, it is generally offered to the same tenant again. We strive to work together with tenants and to manage our properties well. Continuous use and a stable relationship with the tenant contribute to a committed tenant who invests in the leased land, complies with the conditions, and improves soil life. This intention is not published separately. The publication of these general selection and award criteria complies with the Didam ruling. Separate publication has no added value.
Category 2a
When a plot becomes available, we publish it on www.overheid.nl. The lease prices are fixed and therefore do not influence the selection process. If there are several comparable candidates who are willing and able to comply with our policy and conditions, a lottery will be held. The lottery is conducted by Land Affairs in the presence of three people. Applicants who are not selected will be notified of the award to a third party. No further substantive information will be provided.
Criteria
In addition to the requirements set out in the lease regulations, the lease agreement, and the other conditions set out in the Real Estate Policy and these Implementation Rules, the following criteria apply to the selection and award process:
- The tenant runs an agricultural business. The tenant must demonstrate this by enrolment the Chamber of Commerce under the SBI code for agriculture. In case of doubt, the enrolment will be enrolment the selection.
- The leased land is located within a radius of 10 kilometre the tenant's business.
- The leased property must be operated by the lessee himself.
- The tenant can and will comply with HHNK's policy and the lease conditions set by HHNK.
In addition to the above criteria, additional criteria are established for individual plots of land depending on their location, intended use, and condition, with a view to promoting sustainability, biodiversity, and improving soil life.
Plots of land up to 1 hectare in size that become available can also be given to hobby farmers for use (no lease). They can then enrol the plot is published. Commercial farmers have priority in the selection process, and hobby farmers must live within a kilometre radius kilometre the published plot.
In addition to the above, we reserve the right to set additional criteria on a case-by-case basis if circumstances so require. We also reserve the right not to award the plot and to take it into our own maintenance (after all).
Rent
Category 3
Properties that are rented out and whose lease agreement is ending and can be renewed are offered to the outgoing tenant. These properties do not need to be advertised separately.
Category 3a
In principle, a new plot of land available for lease can be offered to the applicant if circumstances permit. The category and criteria are in line with the procedure for Sales, category 1a. If the plot of land available for lease is not yet in use but borders on the applicant's property and, in the opinion of Land Affairs, there is only one candidate, then the applicant may be awarded the lease. The applicant must (be able to) comply with our policy. The intention to award the plot will be published on our website.
Category 3b
Vacant lots for which, in the opinion of GZ, there are multiple interested parties will be offered publicly via www.overheid.nl, depending on the potential yield. We may impose special requirements in the publication, thereby limiting the number of potential interested parties, such as the presence or absence of access to a public road. In principle, the property will be leased to the highest bidder who is able and willing to comply with our policy.
