Custom regulation: what you need to know

Sometimes the general rules in the Water Board Ordinance do not provide enough room for your situation. A tailor-made regulation can then be a solution, so that your activities can take place safely and responsibly. It also provides clarity on how to comply with the duty of care to prevent damage to the water system. What is a custom rule?

A custom rule is a rule that the Water Board itself or at your request can make for special situations. For example, if you want to deviate from a general rule in the Water Board Ordinance or if you want clarification on how to comply with the duty of care. Sometimes the general rules do not work well enough and then we make a modified rule that better suits your situation.

When can I request a custom rule?

You can request a custom rule when:

  • you need an exception because you do not meet the general rules;
  • you need specific requirements that are more or less stringent than the general rules;
  • you want to use a different technique than that prescribed;
  • You want to improve the quality of the living environment with customized solutions.

Measurement regulations also help clarify how to comply with the duty of care in the Water Board Ordinance. The duty of care means that you must take care of the environment and prevent damage. The interpretation of the duty of care can vary from situation to situation. An example is a custom rule for companies about preventing water pollution. This gives companies more clarity on what they must comply with.

How do I apply for a custom rule?

Requesting a tailor-made regulation is done through the Omgevingsloket. Here you log in with your DigiD or eHerkenning (for companies). In the Omgevingsloket you must:

  • indicate the location of your activity;
  • Choose the form associated with your activity;
  • fill in the required data and add attachments, such as Maps or reports;
  • state why you are requesting a custom rule.

Importance of a complete application

A complete application is important for prompt processing. Missing information may cause your application to be temporarily halted. Therefore, check carefully that you have included all information and documents.

How will my application be processed?

Procedure

Once you have sent your application via the Environment Counter, you will receive a confirmation of receipt. We will then check whether your application is complete. If any mandatory information is missing, we will temporarily halt processing until you provide the missing information. Once your application is complete, we will assess whether your activity fits within the rules and whether additional measures are required.

Guideline

In reviewing your application, we use a guideline developed within the Water Board. This document provides us with clear frameworks for assessing whether your activity complies with the rules and is safe for the water system. Terms

The standard period for processing an application for a tailor-made regulation is eight weeks. Sometimes this period can be extended, for example if additional information is needed or if your situation is complex. We will notify you of this.

Cost

You will pay a fee for requesting a custom rule. How high these costs are depends on the nature and scope of your activity. Current fees can be found on our activity information pages and in our fee regulations.

Note: Even if your application is denied, you must pay the application fee.

Permission to use property 

Is the location where you perform the activity (partially) owned by someone else? Then you need private permission from the (co-)owner. If that (co-)owner is the Water Board, please contact the Land Use Team via our contact form or via our general telephone number 072 582 8282.

Is a custom rule mandatory?

A custom rule is only required if you want to deviate from the general rules and your activity does not require a permit.

How do I know if a custom rule is possible?

What if I deviate from general rules without a custom rule?

If you deviate from the general rules without a custom order, we can take (enforcement) action.

Can I supplement my application?

Yes, you can supplement your application while it is still pending via 'My Environment Counter'.
