Customized prescription: what you need to know

Sometimes, the general rules set out in the Water Board Regulations do not provide sufficient scope for your situation. A customized regulation can then be a solution, ensuring that your activities can be carried out safely and responsibly. It also provides clarity on how you can comply with your duty of care to prevent damage to the water system. What is a customized prescription?

A customized regulation is a rule that the water board can establish itself or at your request for special situations. For example, if you wish to deviate from a general rule in the Water Board Regulations or if you want clarification on how to fulfill your duty of care. Sometimes the general rules do not work well enough, and then we create a customized rule that better suits your situation.

When can I request a customized prescription?

You can request a customized prescription when:

  • you need an exception because you do not comply with the general rules;
  • you have specific requirements that are stricter or less strict than the general rules;
  • you want to use a different technique than the one prescribed;
  • you want to improve the quality of the living environment with tailor-made solutions.

Customized regulations also help to clarify how you can comply with the duty of care in the Water Board Regulations. The duty of care means that you must take care of the environment and prevent damage. The interpretation of the duty of care can vary depending on the situation. An example is a customized regulation for companies on the prevention of water pollution. This gives companies more clarity about what they must comply with.

How do I request a customized prescription?

Customized prescriptions can be requested via the Omgevingsloket. You can log in here with your DigiD or eHerkenning (for companies). In the Omgevingsloket, you must:

  • indicate the location of your activity;
  • select the form that corresponds to your activity;
  • fill in the required information and add attachments, such as maps or reports;
  • indicate why you are requesting a customized prescription.

Importance of a complete application

A complete application is important for fast processing. Missing information may cause your application to be temporarily suspended. Therefore, please check carefully that you have included all the necessary information and documents.

How will my application be processed?

Procedure

Once you have submitted your application via the Omgevingsloket, you will receive a confirmation of receipt. We will then check whether your application is complete. If any mandatory information is missing, we will temporarily suspend processing until you have provided the missing information. Once your application is complete, we will assess whether your activity complies with the rules and whether additional measures are necessary.

When assessing your application, we use guidelines drawn up within the water board. This document provides us with clear frameworks for assessing whether your activity complies with the rules and is safe for the water system. The standard processing time for a request for a customized prescription is eight weeks. This period may sometimes be extended, for example if additional information is required or if your situation is complex. We will notify you if this is the case.

Costs

There is a fee for requesting a customized prescription. The amount of this fee depends on the nature and scope of your activity. Current rates can be found on our information pages about activities and in our fee regulations.

Please note: Even if your application is rejected, you must still pay the application fee.

Is a customized prescription mandatory?
