Keur
Note: As of January 1, 2024, the Keur has been replaced by the Water Board Regulation and the Maintenance Ordinance. The regulations listed on this page only apply to permit applications submitted before Jan. 1, 2024.
If you want to perform work in, on, under or next to surface water and water defenses (dikes), you need a water permit. By setting rules we prevent flooding and water pollution. The Keur contains rules that form the basis for the water permit.
What does the Keur say?
The Keur contains the rules that the Water Board uses to protect flood defenses, waterways and associated engineering structures. Together with the Water Act, national and European legislation and the policy rules of HHNK, this forms the basis for the water permit. The rules in the Keur are divided into:
- commandments, which state who must perform what maintenance on water works, such as ditches or dikes. For example, keeping ditches clean or maintaining walkways;
- prohibitions, the purpose of which is to prevent anyone from making changes to the water works, as a result of which they no longer function (properly). For example, it is forbidden to build a jetty without permission;
- tolerance obligations, which describe that owners of land with or near a hydraulic structure must allow our employees and machinery to perform maintenance work. Sometimes landowners are also required to temporarily store water on their land.
Leggers
The leggers contain specific information and Maps. Here you can see where the commands and prohibitions of the Keur apply. We have two different leggers: one for waters and one for flood defenses.
We check compliance with the rules of the Keur on a daily basis. And we conduct an inspection three times a year to check our ditches.
Here's how it works
Permit or notification
If you want to perform work in, on, under, above or next to our surface water or a water barrier, you usually need a permit. In a number of cases a notification is sufficient, for example if it concerns general rules in the Keur. You then proceed in the same way as when applying for a water permit. You submit an application to us. If it appears that your activities fall within the general rules, we will inform you that we regard the information as a notification.
Note: The 2007 Policy Rules for Water Board Exemptions only still apply to the road task (Chapter 6). For the water system and water defenses, the Water Permit Policy Rules 2017 apply. You can download both documents below.
